Terms of service

These terms govern the use of LoyaltyFold, a service operated by Sukhija Techno Aid, a proprietorship registered in India ("we", "us"). By creating a brand account or using the service you agree to them. A brand's separate authorisation, accepted by its owner inside the dashboard, also applies to that brand and prevails where the two differ.
1. The service
LoyaltyFold lets a brand issue reward cards to its customers in Apple Wallet, Google Wallet and on the web, record purchases at the counter or through an integration, and update points, tiers and gifts on those cards. Each brand decides its own rules. We provide the software and issue and maintain the cards on the brand's behalf.
2. Accounts
A brand account is created by a person with authority to act for the brand. The owner is responsible for who they invite, for keeping sign-in codes and staff PINs private, and for everything done through the account. Tell us promptly if you believe an account has been misused.
3. The brand's responsibilities
The brand is responsible for its programme and its promises to customers: the rewards it offers, honouring them, the accuracy of the purchases it records, and the content it uploads. The brand collects its customers' consent where the law requires it and uses the service only for lawful loyalty and membership purposes.
The service must not be used for stored value, cash equivalents, payments, gambling, or anything that breaks Apple's or Google's wallet rules. Points and rewards are not money and cannot be exchanged for cash through the service.
4. Customers of a brand
A person who joins a brand's programme deals with that brand. The brand, not Sukhija Techno Aid, decides what points and rewards are worth and whether to change or end its programme. We operate the card on the brand's behalf.
5. Fees
Fees, billing cycles, trials and cancellation are described on the pricing and refunds and cancellation pages. A brand that does not pay after a grace period may be paused: its cards keep showing their last state but no new points are issued until payment is made.
6. Availability and changes
We work to keep the service available and to fix faults quickly, but it depends on third parties such as Apple, Google, our hosting providers and payment providers, and it is provided as is. We may improve or change features; we will give reasonable notice before removing a feature a brand relies on or changing these terms in a way that matters to it.
7. Suspension and ending
A brand may stop using the service at any time. We may suspend or close an account that breaks these terms, puts customers or other brands at risk, or is required to stop by law or by Apple or Google. On ending, the brand's data is handed over and deleted as its authorisation and our privacy policy describe.
8. Intellectual property
The brand keeps all rights in its name, logo and content and licenses them to us only to run its cards. We keep all rights in the LoyaltyFold software and service.
9. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, lost profits or lost goodwill, and our total liability to a brand in any twelve months is limited to the fees that brand paid us in those twelve months. Nothing in these terms limits liability that cannot be limited by law.
10. Law and disputes
These terms are governed by the laws of India. The parties will first try to settle a dispute by talking to each other; failing that, the courts having jurisdiction over Sukhija Techno Aid's registered place of business have exclusive jurisdiction.
